General Conditions of Sale

1. Subject matter

These Terms and Conditions of Sale (hereinafter: « GTC ») govern all hotel bookings offered by THE CENTRAL (nights, accommodation and associated services), performed:

Any reservation implies full acceptance of these Terms and Conditions without reservation.

3. Reservation

The customer selects his services (dates, type of accommodation, possible options) via the website or by any other means made available by THE CENTRAL.

The reservation becomes firm and final only after the cumulative meeting of the following:

  • validation of the booking request,
  • express acceptance of these GTCs,
  • total or partial payment, according to the conditions specified at the time of booking.

Reservations are strictly nominal, personal and not transferable to a third party, unless CENTRAL has previously agreed in writing.

THE CENTRAL reserves the right to refuse or cancel any reservation in case of unavailability, manifest error, incomplete or manifestly incorrect information provided by the customer.

4. Rates

The rates are indicated in CFP francs (XPF), TGC included, and shall be understood by room and night, unless otherwise stated.

CENTRAL reserves the right to amend its tariffs at any time.
However, the rate charged is the one in effect at the time of the booking validation.

Some additional services (options, specific services) may be subject to additional billing, specified before validation.

5. Payment methods

Payment of reservations can be made:

  • online via secure payment providers (including EpayNC and Stripe),
  • or on site, where this option is expressly proposed.

The total or partial payment condition the final confirmation of the reservation.

6. Security

A surety in an amount of 10 000 XPF is required upon arrival of the customer upon check-in.

This security may be used, in whole or in part, in the event of:

  • degradation or deterioration of premises or equipment,
  • loss of equipment,
  • non-compliance with the rules of procedure,
  • harmful or inappropriate behaviour.

The security shall be returned after verification of the condition of the dwelling or room, subject to a finding of conformity.

7. Cancellation conditions – Non-refundable reservations

The client acknowledges being fully informed and expressly accepting that:

  • all bookings are registered and non-refundable,
  • no refund may be required once the payment has been made.

This policy applies in particular to:

  • cancellation of the stay,
  • non-submission on the scheduled date,
  • late arrival,
  • early departure,

whatever the cause.

Any sums paid shall remain with THE CENTRAL, except in cases of force majeure as defined by applicable case law.

8. Liability

CENTRAL cannot be held responsible for:

  • interruptions, malfunctions or unavailability of the website,
  • damage resulting from the use of the Internet (virus, intrusion, data loss),
  • events involving force majeure or unpredictable and insurmountable events of a third party.

The client is solely responsible for his or her behaviour and that of the accompanying persons during the stay.

9. Personal data

The personal data collected in connection with reservations shall be processed in accordance with the regulations applicable in New Caledonia and in accordance with the provisions of the Privacy Policy available on the site.

The customer shall have the right of access, rectification and deletion of his data under the conditions laid down in that policy.

10. Applicable law – Disputes

These Terms and Conditions are subject to the applicable law in New Caledonia.

Any dispute concerning their interpretation, validity or performance falls within the exclusive competence of the Nouméa courtsunless otherwise required by law.
